These Terms of Service (“Terms”) govern your access to and use of Qoleq’s website and services (collectively, the “Service”), provided by Qoleq (“we,” “our,” or “us”). By creating an event, uploading content, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Qoleq lets event organizers create events, share links or QR codes with guests, and collect photos in a shared gallery. Features, limits, and availability depend on your plan and our current product offering. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable.
You must have the legal capacity to enter into these Terms in your jurisdiction. If you create or manage an event on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for safeguarding organizer links, tokens, and any credentials we provide; activity under those credentials may be treated as yours.
As an organizer, you are responsible for the event details you enter, for sharing access appropriately, and for complying with applicable laws (including privacy and publicity rights of guests). You must not use the Service for unlawful events or to collect content you are not allowed to distribute.
Photos, captions, names or nicknames, and other material uploaded to the Service (“Content”) remain yours or your guests’ as between you and them. To operate the Service, you grant us a non-exclusive, worldwide license to host, store, process, display, and transmit Content solely to provide the Service (including to our infrastructure providers), and to delete Content when events end or as described in our Privacy Policy.
You represent that you have the rights necessary to grant this license for Content you upload or cause to be uploaded, and that Content does not violate these Terms or applicable law.
You agree not to misuse the Service. For example, you must not: upload illegal, harassing, hateful, violent, sexually exploitative, or infringing material; attempt to access others’ events or data without authorization; interfere with or overload the Service; scrape or automate access in a way that harms the Service; use the Service to distribute malware or spam; or circumvent technical limits or payment requirements.
We may remove Content or suspend or terminate access if we reasonably believe there is a violation of these Terms or risk to the Service or others.
Paid plans, pricing, and billing terms are presented at the time of purchase. Fees are non-refundable except where required by law or as we expressly state at checkout. Taxes may apply. If payment fails, we may downgrade or restrict features until payment succeeds.
The Service relies on third-party providers (for example, image storage and payment processing). Their terms and privacy practices may apply to how they process data on our behalf, as described in our Privacy Policy.
Qoleq’s name, branding, software, and documentation are protected by intellectual property laws. Except for the limited rights necessary to use the Service, we grant no other rights. Feedback you give us may be used without obligation to you.
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation or that Content will never be lost (though we describe retention and deletion in our Privacy Policy).
To the fullest extent permitted by law, Qoleq and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim, or (b) fifty U.S. dollars (USD $50), except where such limitations are prohibited by law.
You will defend and indemnify Qoleq against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your Content, your use of the Service, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we need to do so to comply with law or protect the Service. Provisions that by their nature should survive (including licenses to the extent needed to wind down, disclaimers, limitations, indemnity, and governing law) will survive termination.
We may update these Terms from time to time. We will post the updated Terms on this page and change the “Last updated” date. If changes are material, we may provide additional notice (for example, by email or a notice on the Service). Your continued use after the effective date constitutes acceptance of the updated Terms, except where applicable law requires a different process.
These Terms are governed by applicable law without regard to conflict-of-law rules. Courts or tribunals with jurisdiction over disputes arising from these Terms or the Service have exclusive jurisdiction, except where consumer protection laws in your country give you mandatory rights that cannot be waived.
